This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://themoderategenius.com (the “Site”).

Our Site may contain links to third party websites that are not covered by policy. We therefore ask you to review the privacy statements of other websites and applications to understand their information practices.

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

If you work with us as a client, we will collect your name, email address (and other contact details) and your login details for specific online accounts that you use (the “Client Data”).

 

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
Communicate with you;
Screen our orders for potential risk or fraud; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
We may use your Device Information for retargeting advertising via Facebook, Google, YouTube, etc, or for building custom audiences and lookalike audiences. 

 

We use the Client Data in order to provide you with our services, being the outsourcing of your IT support to us. This is necessary for us to provide you with the services. If you wish us to stop processing the Client Data, we will do so immediately, but this will mean we are unable to provide you with the services.

 

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Stripe to power our payments. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. The California Consumer Privacy Act of 2020 (“CCPA”) gives you the following rights:

  • The CCPA gives you the right to request that we disclose the specific pieces of personal information we have collected about you

  • We do not sell your personal information. However, we do disclose your personal data to limited third parties, as described above 
  • Right of deletion 
  • You have the right to request that we delete your personal information, subject to certain exceptions

Disclosures about your personal information 

We collect the categories of personal information from you in connection with your use of our Website as described above. 

Non-discrimination

We will not discriminate against you for exercising any of your CCPA rights.

We may transfer your collected data to storage outside the European Economic Area (EEA). It may be processed outside the EEA to fulfil your order and to receive our services and deal with payment. If we do store or transfer data outside the EEA, we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the EEA. 

This means that sometimes we may need to use legally binding contractual terms between us and any third parties we engage with and the use of the EU-approved Model Contractual Arrangements. 

Data security is of great importance to us, and to protect your data we have put in place suitable physical, electronic and managerial procedures to safeguard and secure data collected through our Website. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality. 

We will still be responsible for protection of your personal data, even where we have transferred it outside the EEA. We regularly review our data retention obligations to ensure we are not retaining data for longer than we are legally obliged to.

 

HOW WE DISCLOSE YOUR INFORMATION

We can exchange information with others to protect against fraud or credit risks We may contract with third parties/subcontractors to supply services to you on our behalf. These include cloud services used to send emails and technology providers that assist in providing services to you.

 

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

 

MINORS

The Site is not intended for individuals under the age of 18.

 

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
